What are out-of-court dispute settlement bodies?

Out-of-court dispute settlement bodies were established under Art. 21 of the Digital Services Act to give users the right to appeal a platform's decision to an independent, certified out-of-court dispute settlement body.

How does it work?

  1. The out-of-court dispute settlement procedure happens online.

  2. The user initiates the procedure by filing a complaint on the relevant body's website via a purpose-built tool (form, complaints panel).

  3. If the user's case meets the admissibility criteria (set out in each body's regulations) — i.e. the case reported by the user falls within that body's jurisdiction — the body begins the out-of-court dispute settlement procedure.

Because each out-of-court dispute settlement body has its own jurisdiction, the purpose of FindODS is to make it easier for users to find the right body for resolving their case.

  1. During this procedure, the body contacts the platform and takes all actions necessary to clarify the reported violation.
